MODESTO, CA – On Thursday, September 26, 2013, the Modesto Police Department was notified of two separate embezzlement cases involving Stanislaus County court clerks.
Dawn Marie Rios, 57-years-old of Riverbank and Barry Lesko, 32-years-old of Modesto were both arrested for embezzlement and subsequently booked into the Stanislaus County Jail. Rios was a 10 year employee and worked as a court clerk at the downtown Stanislaus County Courthouse. She was responsible for collecting court filing fees. Barry Lesko was a 9 year employee and worked at the Traffic Division located at 2260 Floyd Ave.
Both employees are accused of taking money from court fee payments made with cash. The payments would be accepted and marked as paid. The transactions would later be voided, so it would not show on the register. Although Rios and Lesko used similar methods to commit embezzlement, at this time there does not appear to be any evidence indicating they were working together.
Lesko was discovered after a citizen was notified that they were being sent to collections for not paying a court fee. The citizen submitted proof of payment and the incident was investigated.
