Police Make Arrest in Northeast Modesto Shooting

MODESTO, CA – On Wednesday, January 1, 2014, at approximately 5:34 a.m., Modesto Police Officers were dispatched to the 1900 block of Reseda Ln. to investigate a shooting. A female victim called police stating her vehicle was shot at as she drove in front of the residence where her son had been assaulted earlier.

Officers arrived and confirmed the victim’s vehicle had been struck by gunfire. Officers drove to the residence in question and two male adults were contacted outside. One of the males, who was later identified as Johnny Martinez, 25-years-old of Modesto, immediately fled into the residence. The second subject Nicholas Rubalcava, 24-years-old of Modesto, was compliant and he was detained. Rubalcava was found to be intoxicated and unable to care for his safety. He was arrested and booked for public intoxication.

Martinez matched the description of the shooter and officers established a perimeter around the residence. Officers used a patrol vehicle’s public announcement system in an attempt to make contact with people inside the residence. Movement could be seen inside the house, but nobody made an effort to communicate with the officers. 

At 7:40 a.m. the Modesto Police Department’s Critical Incident Team and SWAT team were activated. They responded and took over operations. Officers continued to make announcements and at 9:01 a.m. Martinez and a second suspect, identified as 23-year-old Derrick McConnell of Modesto, exited the residence. Martinez was identified by witnesses as the shooter and McConnell was identified as the main aggressor in the assault that occurred prior to the shooting.

A search warrant was served and several firearms were located inside the house. One of the firearms was found to be stolen.

Derrick McConnell was arrested for Battery Resulting in a Serious Bodily Injury. Johnny Martinez was arrested for three counts of attempted Homicide.
