Modesto OpenAir Initiative

Modesto OpenAir Temporary Outdoor Dining Initiative text logoThe Modesto OpenAir Temporary Outdoor Dining Initiative is a response to Governor Newsom’s July 1, 2020 and Stanislaus County Public Health order of July 13, 2020 prohibiting indoor food service. Restaurants may use this opportunity to expand seating outdoors to remain open while mitigating the spread of COVID-19.

Businesses wishing to participate in the OpenAir initiative need to complete and submit an OpenAir Application.

The OpenAir Program Guidelines and Procedures document provides orientation to the program and the process for participating successfully.

After submitting your program application, you will be asked to sign and submit the OpenAir Program Indemnification Agreement.

For assistance completing applications for outdoor dining, including parklets located in the Downtown area please contact The Modesto Downtown Improvement District by phone at (209) 529-9303 or Email Downtown Improvement District

December California Stay at Home Order - How does it affect OpenAir?

Due to the State of California's Regional Stay at Home Order announced on December 3, 2020--which became effective on 12/8/2020; the City of Modesto will not be issuing OpenAir permit approvals for applications received until such time as the Regional Stay at Home Order is lifted. We will however be accepting and reviewing applications for expedited approval when the Order is lifted.

For more information on the stay at home order, please see the California Department of Health public notice. For more coronavirus information, please visit Stanislaus County's COVID-19 page.

Winter is Coming OpenAir Survey

Take the Winter is Coming OpenAir Survey.  The survey will be open until December 16, 2020.

Thank you to all the businesses that have responded so far to the Winter is Coming Survey.  It's clear, you want OpenAir to continue despite cooler and wet weather. Most respondents plan to continue OpenAir participation with half of those planning to winterize their OpenAir Space. The City of Modesto is looking into possible ways to assist with the seasonal transition.

Project Timeline

Restriping will occur between Friday, September 25, 2020 and Friday, October 2, 2020.  The City will use its best efforts to minimize disruption to businesses in the restriping area.

How will the added outdoor space be used?

This project extends the OpenAir outdoor initiative. Modesto businesses have demonstrated they are creative and determined to succeed despite the challenges brought by COVID-19 restrictions.  This project's added commercial outdoor space provides opportunities for more of that creativity and determination to shine.  All affected businesses are encouraged to take advantage of the program with an OpenAir application.
